On September 2, 1997, Plaintiff Chauna Chambliss was a passenger in a 1983 Pontiac Phoenix driven by her father.  They were stopped at a light in a right turn only lane.  Defendant Diane Rozanski was stopped behind them.  Defendant claimed she thought Chambliss’ car was going forward, so she let her foot off the brake and tapped Plaintiff’s car.  Plaintiff claimed Defendant was not stopped behind her and hit her car with a violent impact.

Plaintiff verdict; liability stupulated; $2,500.00 total amount of award; $1,000.00 medical expenses; $1,500.00 physical pain; Plaintiff contended she was leaning over at the time of impact, with her back off the seat, getting her purse off the floorboard.  However, she had testified three times in her deposition that her purse was in her lap.
